CHIEF JUSTICE ONNOGHEN: Nigeria, A Lawless Entity

On Chief Justice Onnoghen, I believe that most people are more peeved over the procedure than in abating any violation of the law by him. But to the best of my understanding, folks are faulting the procedures, rather than the action of the government.

First of all, I agree that the government was too overzealous in prosecuting the man for omissions on his assets declaration. If a person of the caliber of the CJN did not declare his assets fully, the government's first option is always to bring it to his attention and request an amended declaration. That did not happen here, from what I understand, the government just went off mindlessly to prosecute him and through such over-zealousness embarrassed itself. The CJN or any public officer deserves a one-time opportunity to correct any discrepancies in his/her declaration of assets before prosecution, so president Buhari and his crew were dictatorial and dumb in dragging the man to the tribunal at this stage. 

Second of all, it is not correct that the NJC must first indict a Judge before he or she can be taken to court for violating the law. Nothing in the Constitution gives that role to the NJC over criminal matters; it only pertains to official professional conduct. Usually, such matters don't come until after criminal matters have been taken care of, but the Nigerian courts have criminally conferred that immunity onto Judges and Justices by corruptly interpreting the Constitution to reflect their criminal desires.  

Nigerians are too criminally minded and dishonest that they cannot uphold the law honestly, so Oyibo should be brought back to set up institutions for Nigerians. The legislature distorts the law to assign humongous salaries and allowances to itself; the executive cuts corners to do whatever it wants; while the judiciary brazenly distorts what the Constitution says just to grant itself immunity. The country cannot get anywhere with the mentality being exhibited by those in charge of the affairs of Nigeria. 

What those objecting to the prosecution of judges are actually saying is that a Judge caught red handed commuting murder, terrorism, rape, coup plotting, etc. cannot be arrested right away and prosecuted unless the NJC says so. That is absolutely not what the Constitution says but that is the situation now because the corrupt court system in Nigeria has declared so through a court decision.

Abuja, Nigeria — The Federal Government of Nigeria has inaugurated a 12-member Presidential Advisory Committee on the Prerogative of Mercy (PACPM), tasked with recommending individuals eligible for presidential pardons from criminal convictions. The committee, chaired by the Attorney-General of the Federation and Minister of Justice, Lateef Fagbemi, was inaugurated on Wednesday. GOVERNOR OBOREVWORI APPOINTS OSEJI AS DELTA HEAD OF SERVICE

Governor Sheriff Oborevwori of Delta State has approved the appointment of Dr. (Mrs.) Minimim Oseji as the new Head of Service.
